To succeed in their complaint, the Complainant needed to demonstrate that the disputed domain name is identical or confusingly similar to their trademark, that the Respondent has no rights or legitimate interests in the domain name, and that the domain name was registered and is being used in bad faith.

The Complainant proved ownership of the registered trademark ASCALE, and the Panel found that the disputed domain name is identical or confusingly similar to the mark. However, since the Respondent registered the domain before the Complainant’s rights to the mark existed, the Panel did not find bad faith on the part of the Respondent.

Therefore, the WIPO panelist ordered that the domain Ascale.com should remain with the Respondent, Wyatt Miller.
